Welcome to Tend & Tell. This website, tendandtell.app, and the services offered through it (together, the "Site") are operated by Victoria J. Duerstock (the "Company"). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
The Company grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes โ gathering, tending, and telling your family's stories. Copying, reproducing, or using any part of the Site for commercial purposes requires the Company's prior written permission.
The words, memories, photographs, and answers you and your family contribute through the Site (your "Family Content") remain yours. The Company claims no ownership of your Family Content. By using the Site, you grant the Company a limited license to store, display, edit, format, and print your Family Content solely as needed to provide the services you have purchased โ including producing your digital and printed books and, where included in your plan, editorial tending of your stories. The Company will not publish, share, sell, or otherwise use your Family Content for any other purpose without your written permission.
You are responsible for the Family Content you contribute. Please contribute only content you have the right to share, and be thoughtful about including information about living people without their knowledge.
TEND & TELL, the Tend & Tell name and wordmark, the question bank, the guided-question experience, and all text, design, and imagery on the Site (other than your Family Content) are the property of the Company and are protected by trademark and copyright law. The Company respects the intellectual property rights of others; if you believe material on the Site infringes your rights, contact victoria@victoriaduerstock.com.
This does not apply to your Family Content, which is covered above โ but if you send the Company ideas, feedback, or suggestions about the Site or the service itself, you agree the Company may use them without restriction or obligation of confidentiality or compensation.
The Company works to keep information on the Site accurate and current but makes no warranties or representations as to its accuracy, and assumes no liability or responsibility for errors or omissions in the Site's content.
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS LIABILITY FOR ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE.
That said: the Company deeply understands that the stories entrusted to this Site are irreplaceable, and treats their care as its first responsibility. We encourage you to keep your own copies of precious photographs and documents, and we will always work in good faith to make things right.
These Terms of Use are governed by the laws of the State of Mississippi, without regard to its conflict of law provisions. You agree that any dispute arising from these terms or your use of the Site will be resolved exclusively in the state or federal courts located in DeSoto County, Mississippi.
The Company may revise these Terms of Use from time to time by updating this page. Your continued use of the Site after changes are posted means you accept the revised terms. Please review this page periodically.
